Terms & Conditions
Standard terms and conditions for Chelsea Garden Rooms projects.
The terms and conditions of this contract are not intended to infringe upon the statutory rights given to the customer of the company.
1. Quotations
1. Our quotations are produced with as much detail as possible to avoid any misunderstandings. If something is missing that you would like included, please let us know and we will revise the quotation accordingly. Any additional works found necessary are to be agreed with you the customer and a separate revised or extra contract quotation provided.
2. Working Arrangements
2. All prices quoted are calculated based on free access and unimpeded working during our normal working hours 9am–5pm Mon–Fri & 9am–1pm Saturday unless otherwise agreed.
3. Both company and customer agree to practical arrangements on working methods that provide minimum disruption to the customer and allow work to be carried out efficiently by the contractor in accordance with the company construction phase plan.
4. Free access to premises where work will commence is required for delivery of materials, equipment, etc. Notice will be provided to the customer when possible.
3. Ownership of Materials
5. All building and other relative materials provided by the Company or Contractor remain the property of Chelsea Garden Rooms until full and final payment is received via Credit/Debit Card, Bank Transfer or Cash.
6. Free access to premises for the purpose of collecting any materials surplus or used and/or specialist equipment remains in place until full and cleared final payment is received. Verbal or written agreement is your confirmation to the commencement of works; this additionally activates the contractual Terms and Conditions of your agreement.
4. Labour & Subcontracting
7. After accepting a quotation, Chelsea Garden Rooms may employ both direct and subcontracted labour to work on site. Each individual contractor takes full responsibility for their own third-party liability. The Company will oversee all works up to and including completion and take full general and operational responsibility in the running of any contract agreed with the client.
5. Payment Terms
8. Payment can be made via Credit/Debit Card, Bank Transfer or in Cash with a receipt provided for all payments made. Bank transfer details available upon request. Stage payment terms are agreed in advance of work commencing:
◆ Deposit of 20% required upon agreement of contract.
◆ 50% at Stage 1 required one week before the Installation start date.
◆ 30% Final payment to be made upon receiving your guarantee.
6. Insurance & Public Liability
9. Insurance and Public Liability Insurance is provided up to the sum of £5,000,000. All usual general building practices are covered within our insurance policy. Full policy details are available upon request. Public Liability is insured by Axa business, policy no. 555.314.031 and CPA ‘consumer cover’ company membership no. 5022.
7. Data Protection
10. All customer information is retained in accordance with the UK Data Protection Act and UK GDPR. All personal and other customer data will remain confidential and will not be shared with third parties without your express consent.
8. Price Variations
11. In the event of unforeseen difficulties arising or any other circumstantial changes, the quotation price or estimated cost may be revised to reflect the situation at hand. Any variations will be agreed with the customer in writing prior to proceeding.
9. Guarantees
12. All customers will benefit from a full guarantee on workmanship for a period of 10 years on Garden Rooms, excluding sealed units, all locks, handles and hinges which carry a 5-year manufacturer's guarantee.
13. Our guarantee covers all new work and new materials used in construction, but does not guarantee the integrity of any existing structures, materials or decorations. In the event of a failure beyond the guarantee period, we will investigate the cause and negotiate a solution without delay. Charges may apply for remedial work carried out beyond the guaranteed dates or to items not covered by the guarantee.
14. Guarantees are transferable to subsequent property owners and will incur a £200 administration fee.
10. Extras & Site Surveys
15. Extras will only be undertaken following full discussion with the customer and verbal or written agreement, and charged at the agreed rate. Should a site survey be required before the commencement of works, a surcharge of £200 will apply; this is removed from the final balance upon completion of your installation.
11. Discounts & Retentions
16. Prices are based on the understanding that no retentions are held unless previously arranged and authorised. No main contractor or sub-contractor discounts are given unless agreed and confirmed in writing.
12. Our Commitment
17. We will endeavour to always employ a helpful attitude and will always attempt to bring works to a satisfactory conclusion as soon as possible, considering weather conditions and availability of specialist materials.
13. Building Regulations & Planning
18. All products installed by Chelsea Garden Rooms are built and approved in accordance with regulatory body guidelines. Garden Rooms are generally exempt from building control certification. It is the responsibility of the customer to ensure any localised or specific building regulations are brought to the attention of the Company, as these may affect what works can be carried out without prior planning permission.
Notice of Right to Cancel — Customer Cancellation Rights
You have the right to cancel this contract within fourteen (14) calendar days starting on the day this order is issued. Cancellation must be communicated in writing to the manager at: info@chelseagardenrooms.uk. This cancellation notice must be used to exercise this right and can be issued in person, sent by post (obtain a Certificate of Posting or Recorded Delivery reference), or via email. You are advised to retain a copy of the cancellation notice. All initial deposit refunds will be made within 14 days from the date of cancellation, determined on a case-by-case basis in accordance with your statutory rights.
